ClubLee Conditions

  1. Member agreement

These Conditions set out the contractual relationship between Addison Lee and each individual member of ClubLee.

  1. Definitions

In these Conditions unless the context requires otherwise:

“Addison Lee”: means Addison Lee Limited;

“addisonlee.com” means the ClubLee web pages, which will be changed from time to time, available on the Addsion Lee website at internet address www.addisonlee.com;

“ClubLee” means the Addsion Lee’s loyalty Membership scheme;

“Conditions ” means these Conditions of Use relating to the ClubLee’s loyalty Membership scheme as amended from time to time;

“Digital Card” means, a white, silver, gold or black digital card which represent escalating loyalty Membership Tiers and appear on the app or website after a user logs in;

“Data” means data personal to a Member;

“Force Majeure” means unusual and unforeseeable circumstances which one cannot control and the consequences of which one could not have avoided even if one had taken all reasonable care;

‘’Fast Track” means moving Members to a higher loyalty tier if Addison Lee decide to do to so

“Fraud” includes fraud, dishonesty and deceit and in particular:

  • knowingly supplying incorrect information including at the time of booking to gain Tier Points;
  • attempting to gain Tier Points by taking journeys that are not eligible for Tier Points;
  • altering documents to gain Tier Points,
  • attempting to gain Tier Points for journeys taken by any person other than the Member;
  • attempting to gain Tier Points more than once for the same journey,
  • selling, bartering and/or purchasing Tier Points or Rewards including attempting to sell or transfer Tier Points or Rewards by means of internet based sales or auctions; or
  • knowingly benefiting from the Fraud or Misconduct of another Member or individual;

“Journey” means a single eligible journey between two locations;

“Lifetime Status” means Membership status for the duration of the Membership held by the Member that is offered by Addison Lee to Members;

“Membership Number” means the membership number allocated in accordance with clause 3.5. of these Conditions;

“Marketing Partners” means companies selected by Addison Lee to offer services, products or facilities to Members;

“Member” means the person who is a member of ClubLee and whose app or web profile has a Membership number;

“Membership” means membership of ClubLee;

“Membership Tier” means a white, silver, gold or black loyalty status evidenced by different colour Digital Cards which represent escalating loyalty Membership tiers;

“Misconduct” includes:

  • failure to comply with these Conditions or the terms and conditions of a marketing partner; or
  • attempting to obtain Tier Points by Fraud; or
  • misusing the Services; or
  • misconduct on any Addison Lee journey; or
  • misconduct in dealing with Addison Lee’s staff or the staff of any Marketing Partner;

“Tier Points” means Tier Points earned by Members credited to a Member’s Membership account for the purpose of progressing to a higher status Membership Tier. Tier Points are awarded according to these Conditions or as specified on addisonlee.com;

“Rewards” means any reward issued by, or other goods or services supplied by, or on behalf of Addison Lee including promo codes and discount offers specific to particular Members Tiers;

“Tier Point collection Year” means the 12 month period starting from the day a customer becomes a Member and every consecutive 12 month period thereafter, unless the Member is upgraded to a higher tier or is fast tracked into a higher tier when the Tier Point collection Year will commence on the date of the upgrade;

  1. Membership

3.1 To become a Member, an individual must register on Addison Lee’s mobile app or website.

3.2 Members are automatically placed in the white Membership Tier and can start earning Tier Points as soon as they register on the app or website.

3.3 Some Members may be fast tracked into Membership and some into to a higher Membership Tier. This is offered at the discretion of Addison Lee and Addison Lee may refuse Membership to any customer or inclusion into any particular Membership Tier.

3.4 Members will be given a Membership number once reaching the Silver Membership Tier. Multiple Membership is not permitted and each Member must maintain only one profile. In the event that a Member has multiple Memberships, all Memberships (other than the first Membership approved by Addison Lee) will be cancelled.

3.4 Customers will be admitted to Membership on the date they register. Members agree to be bound by these Conditions (as amended from time to time) and the information on addisonlee.com

3.5 Correspondence will be sent to the Member’s email address then used when registering on the app or website. Addison Lee reserves the right to provide information to Members, including changes to the ClubLee programme.

3.6 Membership will terminate automatically upon the death of a Member, Tier Points accumulated but unused at the time of death shall be cancelled.

3.7 ClubLee is not a members’ or proprietors’ club.

  1. Protection of Members’ Data

4.1 The Data which is processed by ClubLee in connection with Members may include:

4.1.2 Data about journeys booked or undertaken by the Member including Data identifying any account or non-account bookings;

4.1.3 Data supplied by the Member including their name, email and telephone number;

4.1.4 Data collected when the Member is provided with Rewards; and

4.1.5 Data collected when the Member is otherwise in contact with Addison Lee (such as Data about use of addisonlee.com).

4.2 The sources of the Data Processed by Addison Lee in connection with Members may include Marketing Partners, Addison Lee may use older databases and other sources to link together Data.

4.3 Members consent to:

4..3.1 their Data being supplied to Addison Lee,

4.3.2 their Data being transferred to other countries whether or not such countries have data protection laws.

4.4 The purposes for which Data may be processed by Addison Lee or by another recipient of Data under 4.2 include:

4.4.1 providing Rewards to Members;

4.4.2 making changes to Rewards;

4.4.3 accounting and audit, safety and security, fraud prevention and investigation, and systems testing, development and maintenance;

4.4.4 the management and administration of ClubLee;

4.4.5 customer relations and Marketing Partners in future dealings with Members;

4.4.6 credit checking and credit scoring where permitted;

4.4.7 customer profiling and other marketing and market research analysis;

4.4.8 (by or on behalf of Addison Lee) communicating to Members information about ClubLee, including information about ClubLee benefits, using any contact details provided;

4.4.9 (by or on behalf of Addison Lee or Marketing Partners) communicating to Members about other products, services or facilities offered by Addison Lee or other carefully selected companies, using any contact details provided;

4.4.10 conducting market research; and

4.4.11 any other purpose which is obvious or is communicated to the Member;

4.5 It is a term of Membership that Members consent to the use made of Data set out in 4.4.

  1. Use of the digital card

5.1 Members will receive a Digital Card when they register on the app or website, and will be issued with a Membership number when they qualify for the Silver Membership Tier.

5.2 In some circumstances, a physical card may be issued. This is not a credit card and remains the property of Addison Lee.

5.2 Cards are not transferable in any circumstances.

6.0 Membership Tier recognition

6.1 Entitlement to a Black, Gold, Silver or White Digital Card depends on the applicable level of Tier Points credited to a Member’s Membership account. Addison Lee may, from time to time, change the number of Tier Points needed to qualify for each Membership Tier but will inform Members in advance of any changes. 6.2 Digital Card entitlement is based on the number of Tier Points credited to a Member’s Membership account. Each Member’s Membership Tier status will be reviewed at the end of each Tier Point Collection Year before the expiry date of their current Membership. Tier Points can only be counted once. At the end of each Tier Point Collection Year the Member’s Tier Point level returns to zero. Members progress from White to Silver, Silver to Gold and from Gold to Black. In order to achieve or retain Silver status Members must ensure that Tier Points in relation to at least 10 journeys with Addison Lee are credited to a Member’s Membership account during each Tier Point Collection Year. In order to achieve or retain Gold, status Members must ensure that Tier Points in relation to at least 30 journeys with Addison Lee are credited to a Member’s Membership account during each Tier Point Collection Year. In order to achieve or obtain Black status Members must ensure that Tier Points in relation to at least 100 journeys with Addison Lee are credited to a Member’s Membership account during each Tier Point Collection Year.

6.3 A Member’s Tier level may be reduced at Addison Lee’s discretion depending on the Tier Points earned or total number of journeys taken in the previous Tier Point Collection Year. Tier Points earned prior to the beginning of the relevant Tier Point collection Year will not be counted for this purpose.

  1. Lifetime Status

7.1 Some ClubLee members may be awarded lifetime status. Lifetime status will be issued and controlled by Addison Lee.

7.4 Lifetime Status is subject to these Conditions and is dependent on the Member’s continued membership of ClubLee and the continued operation of the ClubLee scheme. Addison Lee reserves the right to amend the criteria for gaining Lifetime Status or to withdraw the ability of Members to earn Lifetime Status and will give at least 1 months’ notice of the change or withdrawal of this benefit.

7.5 Lifetime Status is not transferable and can only be awarded to the Member who has earned the required number of Tier Points or at Addison Lee’s discretion.

8.0 ClubLee Tier Points

8.1 Tier Points can only be earned for travel on eligible journeys at eligible fares with Addison Lee and will be earned by a Member as set out on addisonlee.com

8.2 Addison Lee may, from time to time, alter the rules for earning Tier Points (for example, by altering eligible journeys or fares or the number of Tier Points earned for specific journeys). Members will be notified in advance of any changes.

8.5. Tier Points including Lifetime Tier Points must be earned by the Member and are not transferable.

8.6 Addison Lee may decide that Tier Points may not be awarded for certain bookings.

9.0  Changes to Promo Code Rewards

9.1 If an Addison Lee customer makes a booking without using their available promo code reward, they will not be able to change this.

9.2.Addison Lee reserves the right to curtail any given ClubLee promotion at any time.

9.3 Promo code terms and conditions will be sent out via email to ClubLee Members.

9.4 If there is a maximum usage number to the particular ClubLee promo code and the customer decides to cancel that journey, the journey would count towards the count of the promo codes used.

9.5 For bookings made with Marketing Partners, additional fees may be levied by the Marketing Partner for cancellations on any booking.

10 General

10.1 From time to time, Addison Lee may offer Rewards, special promotional codes to Members and such accruals and/or bookings will be subject to the terms and conditions as published with each offer and which take precedence over these Conditions. Promo codes and other Rewards may not be used in conjunction with other awards, promotions, coupons, discounts or special offers.

10.2 At no time may Rewards be purchased by, sold to, bartered or otherwise transferred to other persons.

10.3 Addison Lee reserves the right to audit a Member’s web or app profile and records without notice to the Member to check for compliance with these Conditions. During an audit a Member may be unable to make ClubLee Reward bookings.

11 Member’s right to terminate membership

11.1 Members may terminate their Membership by writing to clublee@addisonlee.com stating that they no longer wish to be a Member. Any such termination will result in a loss of all ClubLee Tier Points credited to a Member’s Membership account and does not relieve the Member of any continuing obligations under these Conditions.

12 Addison Lee’s right to terminate ClubLee membership

12.1. In addition to any other rights Addison Lee reserves the right at any time in its absolute discretion without compensation or notice to terminate the Membership of any Member and/or (if applicable) the right of having a Membership Tier associated with their app or website profile, including cancelling all accrued and accruing ClubLee Tier Points of the Member and any ClubLee promo or other Reward journeys.

12.2. The Member shall be liable to Addison Lee for the full price of any travel undertaken on ClubLee promo \ Reward journeys, wholly or partly as a result of Fraud and/or Misconduct, with any reasonable costs, including legal fees, incurred by Addison Lee.

13 Termination of ClubLee

Addison Lee may terminate ClubLee at any time. Addison Lee will attempt to give at least one months’ notice to Members and at the end of the period of notice, each Member acknowledges that they will no longer be able to gain ClubLee Tier Points or use Rewards accrued or otherwise.

14 Modification or withdrawal of ClubLee Rewards

14.1. ClubLee may modify, withdraw, amend or add to any Rewards or other offers or arrangements. Addison Lee will give as much advance notice as possible to Members.

14.2. Members shall be deemed to have agreed to any modifications, withdrawal, amendment or addition to the Rewards or ClubLee Tier Points by registering on the app or website.

15 Variation of these Terms and Conditions

Addison Lee reserves the right at all times without notice to make any changes to these Conditions.

16 Exclusion of liability

Addison Lee will not be liable for any Loss resulting from alteration to, or termination of this scheme or the right to earn or redeem ClubLee Tier Points.

17 Customer service

Addison Lee is constantly trying to improve the Services it provides to its Members. Any Member with concerns or complaints should contact Addsion Lee directly. Addison Lee may occasionally monitor telephone calls from Members to the service centre to maintain and enhance its service to Members.

18 Governing Law

18.1 To the extent permissible by local law or regulation these Conditions shall be governed by and construed in accordance with English law. Addison Lee and each Member submits to the non-exclusive jurisdiction of the English courts to resolve any disputes that may arise out of them.

18.2 Any provision of these Conditions declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.

18.3. If there is any conflict in meaning between the English language version of these Conditions and any version or translation of these Conditions in any other language, the English language version shall prevail.
